Legal Challenge
We filed our lawsuit on Friday, May 29, 2026, requesting a Temporary Restraining Order under and Order to Show Cause via the Ex-parte (means without the other party being present) division of the court.
It appears that there is a serious attempt to prevent us from getting Justice, because in violation of procedural laws, Judge Heela D Capell refused to sign the order demanding that we must serve the City, Project Renewal and Empire Prospect LLC (the LLC that owns the hotel) with the papers, before she can take a look at our papers to determine if a TRO can be issued.
This is a grave procedural error as a matter of law, and is in direct violation of our rights to seek emergency relief from the Court. When we went to the new administrative judge, Judge Genine D. Edwards, we were told by her staff that there is nothing that she can do and it is the Plaintiff’s that should speak with the Judge and not the Administrative Judge. However, Judge Capell refused to see us or allow us to be heard on the record regarding this issue.
We will persevere and attempt to get it signed on Monday, June 1, 2026 either through the Supreme Court or through the 2nd Department Appellate Division.
We have also filed a complaint with the New York State Commission on Judicial Conduct regarding the Court’s behavior.
As you can see, not only are the laws being broken by the City but the Judicial system is also breaking laws! Thus, we truly have a fight on our hands!
The case is Boyd vs. Project Renewal Inc. Index # 586/2026
