The Attempt to Endanger the
Petitioners and the Public
Petitioners allege that the City and the Developers are attempting to endanger the Petitioners and their supporters, by filing for an emergency stay of the Temporary Restraining Order, and directing us to appear on Monday, at the Appellant Court, 2nd Department during the City, State and Federal State of Emergency for a non-emergency issue.
Facts!
After the Developers violated the TRO in January 7-9, 2020, which resulted in 5 people being arrested, they went to the Appellant Court 2nd Department requesting that our TRO be vacated. The Appellant Court denied their request.
Now again after the Developers violated the TRO for the second time on March 3 and 4th, they are again going to the Appellant Court 2nd Department to again request that our TRO be vacated!
Their excuse is that they are appealing Judge Boddie’s decision denying their motions to dismiss, which happened on February 20, 2020, over 3 weeks ago!
This Court appearance is being classified as an emergency which it is not. This unnecessary court appearance is now putting us in harm’s way, where no emergency exists on their part and a City, State and Federal State of Emergency has been issued for the Cornavirus.
